Lecture: A commitment to the principles of judicial ethics in Spain to ensure the good functioning of the Rule of Law

The relationship between judicial power and democracy is so tight that judicial power can be considered an essential element in democracy. We analyze how a commitment to the principles of judicial ethics could restore citizens’ faith in the Rule of Law and act against the politicization of judicial power. Judicial ethics pursues the promise of a good justice to achieve the goal assigned to it by the Constitutions: the protection of the rights of citizens. Judicial ethics is the lifeblood that nourishes the proper functioning of the judiciary within the rule of law. The prestige of the judicial power and the confidence of the citizens in the decisions of the Courts of Justice is an essential element of the Rule of Law. The “Good Judge” should respect the three principles of judicial ethics: independence, impartiality and integrity in the exercise of his function, and to know that more than holding a position of honor, he provides a service to society and citizens in a democratic system.

Biography

Cristina Hermida del Llano is a Full Professor for Philosophy of Law. President of the Association of Philosophical Hispanism (2017-2023). Member of the Judicial Ethics Commission in Spain (2020-2024). Corresponding member of the Royal Academy of Jurisprudence and Legislation of Spain since 2006. Jean Monnet Chair by the European Commission (2017-). Author of books, including Aranguren. Study of his life, work and thought (1997); Philosophy of Law and the State. From Socrates to Seneca (1999), co-author with Klaus Adomeit; Fundamental rights in the European Union (2005); Female genital mutilation. The Decline of Legitimation Myths (2017); Racial Justice, Rights and Minorities (2023). Humboldt Fellow, National Science Council of Taiwan scholar and award from National Academy of Sciences of Ukraine. Honored twice by the Federal Republic of Austria.
